| 08/07/2006 | VIOL - PRECAUTION AGAINST FIRE | EGRIFFIN | Violation | Historical data has indicated several significant fires in the past 4 years starting in July of 2002. There have been 3 of these fires in July of 2006 alone. All fires are due to spontaneous combustion of towels/linen contaminated with hydrocarbon based substances. Past measures to eliminate spontaneous combustion of affected towels/linen have not accomplished the elimination of these fires. As of this date the Tucson Fire Department orders Prudential Linen to accept and implement one of the following options: Option #1: Obtain nylon based mesh bags, and place the affected towels/linen in single layers outside of the canopy structure. While in single layers, mist towels/linen until all towels in mesh type bag is saturated with water. The above shall begin immediately when receiving affected towels/based towels. The Tucson Fire Department may order this process under International Fire Code 2003 edition Section 102.8, which states: 102.8 Matters not provided for. Requirements that are essential for the public safety of an existing or proposed activity, building or structure, or for the safety of the occupants thereof, which are not specifically provided for by this code shall be determined by the fire code official. Option #2: If moving affected towels/linen under canopy then the following code shall apply. Under authority under International Fire Code 2003 edition Section 304.3.1, which states: 304.3.1 Spontaneous ignition. Materials susceptible to spontaneous ignition, such as oily rags, shall be stored in a listed disposal container. Contents of such containers shall be removed and disposed of daily. This container shall be listed and constructed of metal with a self-closing lid. Option #3: A consultant shall be obtained under the below fire code requirement. The consultant shall submit a plan to The Tucson Fire Department for approval. International Fire Code 2003 edition Section 104.7.2, which states: 104.7.2 Technical assistance. To determine the acceptability of technologies, processes, products, facilities, materials and uses attending the design, operation or use of a building or premises subject to inspection by the fire code official, the fire code official is authorized to require the owner or agent to provide, without charge to the jurisdiction, a technical opinion and report. The opinion and report shall be prepared by a qualified engineer, specialist, laboratory or fire safety specialty organization acceptable to the fire code official and shall analyze the fire safety properties of the design, operation or use of the building or premises and the facilities and appurtenances situated thereon, to recommend necessary changes. The fire code official is authorized to require design submittals to be prepared by, and bear the stamp of, a registered design professional. Failure to implement one of these options within 2 weeks of receipt of this letter will result in the Tucson Fire Department recommending action for civil penalties to the City of Tucson Prosecutor and a compliance hearing thereafter for the fire code violation stated below. 305.4 Deliberate or negligent burning. It shall be unlawful to deliberately or through negligence set fire to or cause the burning of combustible material in such a manner as to endanger the safety of persons or property. This letter is to inform you that implementation of this International Fire Code options must begin by August 14, 2006. |
