02/15/2023 | COT - ENFC - Code Enforcement - Follow Up | Completed | After waiting for about 15 minutes the boyfriend came with the key and a minute later the owner came back to the property. The tenant was yelling at me and mad because I called the owner to return to the property. Rachael was being very combative and resistant to my attempts to have her schedule a time and date for the owner to come fix her unit, she actually refused to make any concessions to the owner and only insisted that I come inspect her unit. I was finally allowed in the unit and while there, I observed very unsanitary conditions. There was dog waste, fresh and old, spread throughout the unit on the floor. There were holes in several walls and a big hole in the ceiling where it appeared to be water leakage. While in the unit I noticed she had no electricity and Rachael told me she was in contact with TEP to get it back on. I asked her to provide me proof that she was getting her electricity turned back on. I contacted TEP and I was informed that the power to the unit was cut due to non payment since 1/5/23. I informed Racheal that I would have to condemn her unit because it was unsafe to occupy and she immediately began to cry and apologize for "causing so much trouble". I told her that she was only allowed to enter the unit during the daytime hours to work only to remove her items and if she or anyone is caught inside the unit that they could be subject to arrest by TPD and 2/17/23 was her final day to retrieve her items from the unit. Her and her boyfriend acknowledged in front of myself and the owner that they were behind on the rent two months. Rachael told me that she withheld her payments purposefully in an attempt to force her landlords hand in some way to fix other items in her unit. I told her that she must not withhold rent payments and I was not able to stop a lawful eviction. |
