For sites required to provide EV charging, UDC §7.4.12(C)(4) requires that installed EVSE be accessible for EV charging during business hours; non-functional stations do not meet this standard. The UDC’s EV design criteria also state EV spaces must be designed so drivers can utilize EVSE without undue inconvenience and so charging is feasible in the required number of spaces (UDC §7.4.12(A), (B)). Separately, the deteriorated condition is a visual blight visible from the public right-of-way and may constitute a public nuisance under Tucson Code §16-34 and a building/structure exterior maintenance issue under §16-12. Please inspect and require the owner to repair/replace the units or otherwise bring the site into compliance. Thank you. |
