The applicant proposes to change the residential use to an office use. The proposed new use of the building requires the entire site be brought into compliance with all Land Use Code (LUC) development criteria applicable to new development. The applicant is requesting Board of Adjustment approval of the following variances: 1) Reduce setback of the existing principal structure from the north lot line from ten feet five inches (10'5") to seven (7') feet.; 2) Reduce setback of the existing principal structure from south lot line from ten feet six inches (10'6") to seven (7') feet.; 3) Delete the one required twelve (12') foot by thirty-five (35') foot loading space; 4) Reduce the number of motor vehicle parking spaces from nine (9) spaces to six (6) spaces; 5) Delete the continuous pedestrian access (sidewalk) between the principal structure and the accessory structure (storage shed); 6) Delete the five (5') foot high masonry screen walls along the north, south, and east property boundaries where the chain link fence is existing, as shown on the submitted plan; 7) Delete the ten (10') foot wide street landscape border; 8) Delete the screening adjacent to the parking lot; 9) Allow vehicular maneuvering directly into the right-of-way; and, 10) Delete the requirement to pave and seal the parking lot area, as shown on the submitted plan. SPLIT DECISION: Variances 1, 2, 3, 4, 5, 6, 8, 9, and 10: Granted, as Requested. Variance 7: Granted Subject to the Following Conditions: A) Provide a landscape border to the extent that adequate onsite traffic maneuvering is maintained. B) Landscape border to be placed directly adjacent to back of sidewalk in the right-of-way. C) Provide at minimum a two-way drive. D) City Engineer approval required for traffic maneuvering and location of landscaping within the right-of-way.
